You can seek an Unmarried Partner Visa or Same Sex Partner Visa to help bring in a non-EU partner to live and work.

In the UK, LGBT rights are highly protected. Same sex couples have the right to marry and have equal rights to adopt or seek parental responsibility for a child.

In order to be successful in an application for one of these visas, you will have to prove you are in a genuine and subsisting relationship. After acceptance, you can apply for Indefinite Leave to Remain after a period of five years.

Dependant Visa

A UK Dependant Visa covers family members who have or are applying for a Points-based-Visa. These usually cover spouses and civil partners, unmarried and same sex partners, and children under 18 at the time of the application. For anyone not covered by these, it is unlikely that you will be accepted.

If accepted, you will be able to work and study in the UK, although there will be some restrictions. You children will be entitled to go to school here and your family will be able to remain together.

Spouse/Civil Partner Visa Extension

You may be entitled to seek a further extension to your Spouse visa or Civil Partnership Visa for a further period of 30 months. This will more than likely take you past the 5-year threshold allowing you to apply for Indefinite Leave to Remain.

You will have to meet certain requirements, including the minimum income threshold. There are strict policies that the Home Office follow and understanding these can help avoid a stressful situation of your application being refused.

Most frequent questions and answers

Those subject to immigration control and holders of an Unmarried Partner Visa or Same-Sex Partner Visa will not be able to rely on public funds during their limited leave to remain visas.

If you are a single parent, the following conditions will need to be met for your child to obtain a UK Dependant Visa:

  • You are the sole surviving parent of the child(ren); or
  • You have ‘sole responsibility’ for the child(ren); or
  • There are serious or compelling family considerations which must be considered by an immigration official examining your application.

The best way to prove you and your spouse/civil partner have been cohabitating over the course of your visa is to provide items such as utility bills in both your names and bank statements showing rent or mortgage payments coming out of a joint account as part of the documents you submit with your visa extension application.
